    Session Details:

    A panel discussion of experts focused on the financial aspects and complex financial issues of adjudicating disability claims.  It will begin with the basics and end with complex issues investigated in forensic accounting investigations.  The panel will also discuss how to analyze the occupational duties and activities for professionals (physicians, attorneys, accountants).  Bring your questions and get ready to spend the morning with the CPAs.

    The session will be presented by Ernie Smith, John Hoffman and P. Dimitris Bantileskas all from Nawrocki Smith LLP.

    Joseph M. Hamilton

    Joe concentrates his practice in life, health and disability insurance defense, ERISA, and land use litigation, including environmental litigation. He is a past member of the Firm’s Management Committee and the chair of the firm's Litigation Group.

    He serves as counsel for numerous life, health and disability insurers, and self-insureds at all levels of state and federal courts throughout Massachusetts. His representation includes the full spectrum of issues arising from both individual and group coverage, under both state and federal law, including ERISA. Joe also represents business clients in addressing litigation issues that arise in the context of land use and environmental concerns. This includes representing clients in connection with administrative appeals and enforcement actions involving the Massachusetts Department of Environmental Protection and the Environmental Protection Agency as well as actions involving private parties, including litigation related to contaminated property and regulatory compliance.

    Joe has been named a Massachusetts "Super Lawyer" by Boston magazine and Law & Politics every year since 2008.

     

    J. Christopher Collins

    J. Christopher Collins ("Chris") joined Mirick O'Connell in October 2015 as a member of the Life, Health, Disability and ERISA Litigation Group.  Chris is known both locally and nationally for his extensive experience in litigating first party bad faith matters and insurance cases governed by ERISA.  He has managed numerous class action matters involving Securities, 401(k), False Claim Act, Retained Asset Accounts, and many dealings with insurance and ERISA-related issues.  Prior to joining the Firm, Chris was Senior Vice President and General Counsel at Unum US, the largest provider of group and individual disability insurance in the U.S. and a fast-growing voluntary insurance business with over $6B in annual revenue.  In that role, he provided counsel and managed all of the legal resources serving Unum's largest business sector.  During his tenure at the company, he helped to lead the legal department through both acquisitions and mergers and was a key participant in working to solve significant regulatory challenges facing the company in the early 2000's.

    Chris' practice focuses on life and health insurance matters with a concentration on disability income insurance and will assist the Firm in client development both locally and nationally.  He will also continue to serve the community in a broad array of philanthropic activities.  

    Chris is very active in the Worcester community, having served on numerous boards for non-profit entities, including the Worcester Regional Chamber of Commerce, Greater Worcester Community Foundation and Worcester Regional Research Bureau; he also currently serves as Chair of the Nativity School of Worcester and is a Council member of the American Antiquarian Society.  As lead executive on the Unum Worcester campus, he was the company liaison for many issues concerning the company and the City of Worcester, including the development of the new Unum building at City Square.

    Throughout his career, Chris has been a frequent speaker and panelist at numerous industry conferences.  In 2013, he was the keynote speaker at the Definitive Disability Conference ("DDC").  In addition, he has participated at forums and events sponsored by the Worcester Regional Research Bureau, the Chamber of Commerce, and the City of Worcester.

    This golf event will be a shot gun start, 4 members per team, best ball/captain and crew style of play. Contests included within the round are closest to the pin, closest to the line, and longest drive. There is a women’s and a men’s prize for each contest. Lunch is included with the round.     James M. Slayton, M.D., M.B.A.
    Title of Presentation: Impaired Professions - Burnout

    Dr. James Slayton has served as the National Medical Director for Outpatient Services with Optum Behavioral Health. His career in managed behavioral health care spans over 20 years. He has served as a consultant with PsyBar since 2010. He is a clinical instructor of psychiatry at Harvard Medical School and former associate director of residency training at Boston University School of Medicine, as well as former Director of Ambulatory Services at the Cambridge Health Alliance in Massachusetts.

    Dr. Slayton is a Distinguished Fellow of the American Psychiatric Association. He received his Master's Degree in Business Administration from the Harvard Business School, and his M.D. Degree from Stanford University School of Medicine. He has had an exclusive affiliation with PsyBar as a psychiatric consultant since 2010.

    David Fisher, Ph.D., ABPP, L.P.
    Title of Presentation: Fifteen Ways Insurance Claim Departments Can Get Defensible, Fair and Cost-Effective IMEs and File Reviews

    David C. Fisher, Ph.D., LP, ABPP is a Diplomate in Clinical Psychology and has been president of PsyBar LLC since 1995. Dr. Fisher oversees psychological and psychiatric independent medical evaluations, file reviews, and other assessment services performed across the country through PsyBar’s network of 1,800 psychologists and psychiatrists. He is a recipient of the Innovative Practice award, given the by President of the American Psychological Association, in recognition of the innovations in psychological assessment he introduced through PsyBar. He publishes and lectures across the United States and abroad on psychiatric and psychological assessment, and has developed assessment protocols used by psychologists and psychiatrists nationally.

    Janet L. LaBreck

    Title of Presentation: Role of Service Dogs in the Workforce

    About the presenter: In February of 2013, President Barack Obama announced some key administration posts, including his intent to nominate Janet L. LaBreck, known as a national thought leader and key note presenter as the Commissioner of the Rehabilitation Services Administration (RSA), within the United States Department of Education. In August of 2013, LaBreck was confirmed by the United States Senate as the Commissioner of RSA. RSA was established to provide leadership and resources to assist state and other agencies providing vocational rehabilitation services (VR) to individuals with disabilities to maximize their employment, independence, and integration into the community and workforce.

    Under her leadership, LaBreck was responsible for promulgating the most substantive regulation changes to the Vocational Rehabilitation program in over 15 years. She began her 27-year career with the Massachusetts Commission for the Blind (MCB) where she served as Commissioner during the last six years of her appointment by Governor Patrick until her transition to Washington, D.C. She is also the recipient of numerous awards and honors including an Honorary Doctoral Degree from New England College of Optometry (NECO) for her innovative partnership which resulted in the establishment of a mobile eye care clinic for individuals with low vision conditions. In 2017, NECO dedicated the Janet L. LaBreck Center for Low Vision Rehabilitation clinic in her honor in recognition of her commitment and dedication to the field of blindness. Most recently, LaBreck has established Janet L. LaBreck Consulting LLC in addition to becoming the Founder of Synergy Consulting Partners.

    Abigail O’Connell

    Title of Presentation: The Impact of Paid Family and Medical Leave laws on Disability Insurance

    About the Presenter: Abigail O’Connell is senior counsel at Sun Life Financial, advising Sun Life’s Group & Voluntary business on legal issues related to the Sun Life Absence & Disability Management Solutions offered to employer Clients. She frequently speaks at industry conferences about legal and compliance issues related to absence management. Some of Abigail’s recent speaking engagements have included:

    • 2015, 2016 and 2017 Disability Management Employer Coalition (DMEC) Annual Conference
    • 2017 Greater Philadelphia Association of Health Underwriters Conference
    • 2018 Annual Association of Corporate Counsel Conference

    She is a graduate of Colgate University and Suffolk University Law School.
